    Stamp duty question regarding owning 2 properties

    Hi,

    My wife and I owned 2 properties, one was our main residence and one rented out. We got posted into Military accommodation a couple of years ago; for a period both properties have been rented out because we had no choice due to work. Since then, we have sold one of the properties (our old main residence -sold dec 21) and now purchasing a a replacement to move into and live in.

    We paid higher rate on the purchase of the second home , as it was not our main residence.

    As long as you can demonstrate you are replacing your main residence and that your previous main residence has been disposed of then the surcharge wouldn’t apply.
    It is a self assessed tax ultimately but I would recommend you give the HMRC stamp duty helpline a call, although perhaps not today given the changes announced.

    IIRC there is a time period for the sale and purchase of the main property.
