    Rolex tries to grab rights over the term "milsub" but fails

    I'm not a great fan of the abbreviation, but the attempted "land-grab" is interesting :

    TLDR: “Rolex’s attempt to assert rights in the term MilSub fails because no one, not Rolex and not the public, has ever used the term MilSub to identify a currently available watch sold by Rolex. With no trade, ever, under the term MilSub, Rolex cannot assert rights in the term.”*

    I can't see why Rolex tried to do this.
    Yes, it was a name in common parlance prior to the (3rd party) attempt to register it, often (but not always) referring to Rolexes, but Milsub was never a Rolex-generated phrase, and never really used by them to refer to any products.
    Seems like the right decision.

    No gratuitous pics either, but thanks Haywood for posting the piece.

    Not the first time that Rolex have tried it on, but when you think about it the ruling makes perfect sense: the company never offered Milsubs for retail when new, and I bet one has never come through their eye-wateringly priced pre-owned range, so they can’not sustain a claim of trademark violation.

    The findings of the US Court contain extensive and interesting content, not least revealing the extent of monitoring that Rolex or their agents undertake but also references to many individuals and companies familiar to this community, and apparent confirmation of "the milsub story" as we know it. I also see "recycled" information that many of us would now consider should be updated / corrected :

    I was reading a book about tax today and one of the many interesting things it includes is that Harley Davidson once tried to patent the sound of their bikes.

    Hadn’t heard of the divorce one before but I think film investment is what did Beckham and maybe Jimmy Carr over a few years ago.

    Wonder how it will apply one day to people with vast BTL portfolios in ltd companies.

    Funny how all the ire and legislating around landlords mainly affects small time landlords and those using property as a retirement strategy, while corporates and the workarounds/loopholes they use are completely ignored.

    Interesting, a well-to-do investment banker friend was in Cannes a few years ago, as he was a random investor / partner. Now becomes clear!

    Slightly related, but (maybe just in the US) Tudor have TM’d snowflake hands (the shape, not the name) and sent a C&D to at least one microbrand that uses them.
