    Drive Throughs and Mobile Phones

Is using your mobile phone to pay for goods in a drive through breaking the law?

Common sense sense dictates a load of nonsense, but what if your foot slips off brake or onto accelerator and a crash ensues. What then??

Driving laws also apply to public places.

It’s all moot given there’s no one enforcing the road laws as it is.

An early contender for pointless thread of the year!

Points to note: The vehicle is stationary, the phone is a method of payment so its not being used to make or receive a call its effectively a electronic plastic card.

I am slightly envious that life could be so perfect anyone has time to consider this conundrum or possibility.

You can get a ticket for using the phone while the vehicle is stationary?

I was in the lane next to an unmarked police car yesterday, the driver clearly thought it was ok to pay using his phone.

    Who am I to argue?

But, to be fair you, are reflecting on him considering his conundrum, which must mean your life is one step closer to perfect

    It’s not. It’s a ‘road’ by definition.

No need for foot on brake pedal. Stationary vehicle, handbrake on, in neutral. Job done.

I think you will find that road traffic legislation does apply because the public have access to the drive-through. So you can be prosecuted for drink/driving offences for example, which makes sense.
I'm pretty sure that I read that payment via the mobile device is exempted as it's not an interactive communication function, which again makes sense.
Of course you can't scroll through your playlist on your phone, but can on your cars ICE screen, which doesn't make sense.

I believe if the vehicles engine is running or the keys are in the ignition you are deemed to be in charge of the vehicle and can be charged, sure someone I know was done for drink driving even though he was running the engine to keep warm, turfed out his house by angry wife during a raging argument so sleeping in the car.

Isn’t this one of the new regulations that have just gone through parliament so you can use them in drive throughs.

Not where there is unrestricted access.

Still in charge of vehicle therefore ‘driving’

    Motion is irrelevant

    Coming soon, it appears:

Annoys me that while mobile phone use (and soon even holding) is forbidden, I see loads of smokers and vapers clutching cigarettes/electric vape things while driving. No-one's ever explained how it's safe to get a cigarette out of a packet, light it and smoke it all while driving.

I was referring to the foot slipping off of the pedal.
